Motion to Dismiss Lippa/Miller Paving Appeals

Last summer, on a hot day in July we sent a note to everyone to announce the Ontario Land Tribunal (OLT) had ruled in favour and a Motion to Dismiss the appeals made by Lippa and Miller paving against the Township of Muskoka Lakes (TML) new Official Plan (OP) was successful.

We were ecstatic.

In an unprecedented move, the Chair of the OLT has unilaterally overruled that decision. Citing errors in the original decision, the Chair has ordered the Motion to Dismiss to be reheard by a new panel of adjudicators.

Is this a setback? Yes. Are we giving up? Never.

A new Motion to Dismiss is scheduled to be reheard on Friday, December 12^th, 2025 at 10:00 a.m.

We hope that you'll tune in and demonstrate to the OLT that we are not backing down.

Our lake community is as strong as ever. Over the past years we have shown up in full force to the virtual hearings as a way of demonstrating the power we have to defend our lake’s future. And the OLT has noticed. Let's keep that momentum going.

Fire Station Update

At the upcoming Council Meeting, scheduled for Wednesday, October 15, 2025, at 1:00 PM, staff will be recommending the adoption of the 7 Fire Station Model as outlined in the Fire Station Location Study. This Study recommends the closure of three existing fire stations.

Muskoka Regional Center/Cliff Bay Proposed Development

Dear Lake Association colleagues,

I'm writing to share details of the MLA's recent actions regarding the massive development proposed by Cliff Bay Muskoka Corp. in Cliff Bay, Lake Muskoka. As fellow lake-lovers, we invite you to share this with your members and others who are passionate about clean water, natural shorelines and the character of our lakes.

The MLA remains deeply concerned about the negative impact the current plan will have on the environment and the character of Cliff Bay and South Muskoka.

The proposal includes thirty-three villas and two restaurants in the lake, up to ten six-storey buildings, three hotels, almost 1,400 units and 80 boat slips as well as minimal proposed setbacks, public parkland or protection for existing trees.

We are strongly opposed to the developer’s proposed draft Ministerial Zoning Order (MZO), which also has the effect of bypassing local planning rules.

Here's how we are making the views of our members known:

In a meeting with the developer and team on July 9, we shared our concerns about the over-the-lake building proposals, insufficient shoreline setbacks and potential environmental impact, as well as the lack of specific job guarantees.
In a news release issued on August 6, 2025 we urged Gravenhurst Council and the Ontario government to scale back the development to conform more closely to the Town of Gravenhurst’s Official Plan policies for Urban Resorts and the Town's Comprehensive Zoning By-law, as well as the District of Muskoka’s Resorts Policies.
In letters to provincial and municipal leaders on June 25, 2025, we've asked them to require resort development be in keeping with the character of Muskoka.
In a meeting with the MPP for Parry Sound-Muskoka, Graydon Smith, we shared our concerns and urged the plan not be approved as proposed.

We're raising awareness of the issues through our social media campaign on Instagram and Facebook. We invite you to like, share and repost.

Fire Station Location Study

The Township of Muskoka Lakes is entering the final phase of its Fire Station Location Study, a multi-year planning initiative to ensure safe, effective, and financially sustainable fire protection services over the next 25 years.

On August 13, 2025, Fire Chief Ryan Murrell presented a Fire Station Location Report to the General/Finance Committee. The report outlines the financial strategy and implementation plan for three service models developed through earlier phases of the study.

The Committee has recommended that the Fire Station Location Study and the 7-Station Model contained within, be adopted. Before this decision moves forward to Council for final approval, the Township is inviting the community to share any final input or questions to help inform the upcoming discussion at a future Council meeting.

Many of our cottagers are concerned about the potential closing of Raymond Fire Hall because of the possible decrease in response times and potentially negative insurance implications.

The Ontario Land Tribunal Rules Overwhelmingly in our Favour

A significant win for the SLCO and all of Muskoka

The SLCO has been sharing with you the news as it happens in our collective fight with the MLA and other lake associations to defend the Township of Muskoka Lakes Official Plan from the appeals brought by Our Muskoka, Miller Paving and Lippa.

As you know, we have been planning to hold a ‘Stand Up for Muskoka Rally’ on August 9, 2025 to demonstrate how important the Official Plan is to the future of all Muskoka Lakes.

Today we have some very positive news to share.

In May the Muskoka Lakes Association filed a motion with the Tribunal to dismiss the appeals. We were notified this week the Tribunal ruled in our favour and all appeals have been dismissed. The appeals, had they been successful, would have resulted in the removal of long-standing policies protecting the unique environment of Muskoka including limits on lot coverage and a 2,000-meter buffer zone from lakes for aggregate pits and quarries.

Due to the Tribunal's ruling, the Rally to Stand Up for Muskoka, scheduled for August 9th at the Milford Bay Community Centre, has been cancelled.

This does not mean the fight is over! We continue our work supporting the Township of Muskoka Lakes as it amends its Comprehensive Zoning By-Law which implements the Official Plan. The MLA and partners are active participants in that process.

Appeal of Township of Muskoka Lakes Official Plan

VIDEO HEARING - Wednesday, Sept 11, 2024, @ 10:00 a.m.

As reported earlier this year, the Township of Muskoka Lakes new Official Plan (OP) is under appeal. Of prime importance to Skeleton Lake cottagers and residents is "Section K - Aggregates" which is being appealed by Frank & Elizabeth Lippa and Miller Paving Ltd.

The appellants are seeking to overturn important safeguards the township has written into the new OP that keep new pits & quarries a safe distance from our lakes.

The Ontario Land Tribunal (OLT) will hold its second Case Management Conference (CMC) this coming Wednesday Sept 11, starting at 10:00 a.m. by Video Hearing.

Members are strongly encouraged to participate in this hearing by clicking on the link below. Our strength is in our numbers and it's very important to our case to make sure the OLT knows there is overwhelming community support in keeping these OP policies in place that protect our lake.

Appeal of Township of Muskoka Lakes Official Plan

The SLCO worked very hard and, with the assistance of our local Councillors in Muskoka Lakes, successfully embedded important parts of our Stewardship and Lake Plan into the Township of Muskoka Lakes Official Plan. The SLCO, with assistance and support of other lake organizations, was also successful in encouraging Council to continue with the existing policy that prohibits aggregate operations within 2km from the Waterfront areas in the Township, while adding strengthening wording to it.

Although District staff was offering alternative wording, District Council supported the Township Council and approvedthe policies and wording that we had worked so hard to get into place.

Unfortunately, there have been a number of appeals filed with the Ontario Land Tribunal (OLT). Lippa and Miller Aggregates have appealed the proposed aggregate policies. A group called Our Muskoka, largely made of representatives of the development industry, have appealed our Skeleton Lake specific policies related to a 1 ha minimum lot size and 90 m minimum frontage for new lots.

Where do we go from here?

The OLT has set up a file (OLT-24-000035) to hear the appeals. An online Case Management Conference has been scheduled for March 21, 2024 to meet with the groups who are planning to participate in the hearing to determine:

Who will have party status (attendance, expert witnesses, right of cross examination)

Who will have participant status (written submissions only will to be considered by the Tribunal)

Hearing duration and scheduling including deadlines to file:

a list of witnesses,
evidence outlines,
meetings of like-witnesses for opposing parties,
Dates to file visual evidence

The Case Management Conference is not a time to present opinions or arguments, but rather an exercise to direct traffic. The SLCO and other lake organizations will attend the meeting to request party status at the hearing.

Message to Members re: ZBA-68/21 Skeleton Lake Marina Docking Expansion

The purpose of this note is to keep you informed about an application by the Skeleton Lake Marina for a proposed Zoning Bylaw Amendment ZBA-68/21 to expand docking at the marina.

Specifically, Skeleton Lake Marina has applied for a zoning bylaw amendment to add 14 additional docking spaces plus automobile parking to the existing marina.

The proposed amendment will be heard at the Township of Muskoka Lakes Planning Committee Meeting on Thursday April 14, 2022.

The SLCO understands that this application potentially adds additional traffic to an already busy bay. The SLCO will recommend the Township address safety issues in this area and consider posting channel markers and speed recommendations for boaters in Beaman's Bay.

The aggregate component of the OP unfortunately does not strengthen the wording to prevent mineral aggregate operations in/near waterfront property as SLCO, Councillors, Planning Committee members and many of you have requested.

The present OP is very specific and states:

“Due to widespread existence of granite outcrops in the Township and the economic viability of crushing this resource into gravel, new rock crushing operations shall be limited to areas:

-farther than two kilometres of a boundary of an Urban Centre: and

-farther than two kilometres from the Waterfront designation" (emphasis added)

The first draft of the revised OP is much weaker and states:

“New rock crushing operations shall be discouraged within 2 kilometres from the boundaries of the Waterfront Area designation” (emphasis added)

It also states:

The Township shall not generally support the establishment of new mineral aggregate operations in the Waterfront Area designation through an Official Plan Amendment, because of the potential negative environmental, social, and/or economic impacts (visual and otherwise) related to Muskoka’s lakes and rivers.

We of course are very concerned regarding the weakening of the wording including only ‘discouraging’ and not ‘limiting’ within 2 kms of waterfront, as well as the wording that says the Township will ‘generally’ not support.

We have other concerns that the wording has not been strengthened -which SLCO and councillors proposed during the discussion phase of the review.

SLCO has requested standing on Thursday, April 1//21 and we will present our concerns. We invite you to observe any one of the dates by clicking the links above.

We are hoping that the next OP iteration will reflect the concerns raised. We will keep you informed of our progress and whether we will require your advocacy as we move through the OP review process.

Dear Matthew,

Thank you for extending the Public Consultation period and for meeting with our executives to discuss this proposal in some depth.

As conveyed to Canacre and yourself, the Skeleton Lake Cottagers Organization (SLCO) represents the interests of a majority of approximately 500 cottagers and other residents of Skeleton Lake watershed.

While the SLCO appreciates that Bell Mobility is proposing to improve local mobile cellular LTE voice & data service and fixed wireless broadband service through their proposed tower, the SLCO OPPOSES the 61m free-standing, steel-lattice tower W7716 to be erected at 4300 Aspdin Road because of the significant negative impact to the scenic views on the northwest shore of Skeleton Lake.

The SLCO has a mandate, supported by the majority of its members and other residents around the Lake, to preserve the physical features and values of Skeleton Lake for generations to come. Landscapes and scenic views are paramount among those values as defined in our Lake Plan and Stewardship Program. A 61m, free-standing, steel-lattice tower within such close proximity to the shores of Skeleton Lake, sitting atop a 60m precipice, would forever be an eyesore and diminish the enjoyment of the Lake’s residents.

The Township of Muskoka Lakes has recently passed a motion adopting Skeleton Lake’s ‘Lake Plan and Stewardship Program’ into the Township’s Official Plan, recognizing the community’s desire and authority to protect, among other features, its scenic views.

The Township of Muskoka Lakes in their “Interim Policy Communication Tower” also calls for “siting of new communication towers shall consider the … retention of prominent views and vistas”.

As well, our members have indicated their preference and need for fixed wireless broadband services as an alternative to expensive mobile cellular data access to the internet, a service already available to most of them. We note, and as you confirmed, the coverage maps provided by Canacre depict mobile cellular LTE voice & data coverage and NOT fixed wireless broadband coverage.

Based upon an analysis that SLCO has performed using advanced radio coverage modelling software, we believe that our members can still achieve vastly improved fixed wireless broadband service with a shorter 30m “monopine” tower erected on the same high precipice at 4300 Aspdin Rd. In the event that a 30m tower is not sufficient to achieve the desired cellular coverage then perhaps two strategically placed 30m towers along the north shore and Aspdin Rd. could provide the desired improved mobile cellular coverage as well as fixed wireless broadband without significantly diminishing scenic views.

We also note that the construction of this tower is not scheduled until the “building season” of 2022 meaning that improved mobile cellular LTE voice & data service and fixed wireless broadband service is not expected until late in 2022. Our members would benefit from having improved fixed wireless broadband services now, especially during this pandemic. This proposal does not meet the immediate needs of the community, yet we are aware that other fixed wireless broadband service operators will, in all likelihood, be able to satisfy much of that demand in the current year.

We stand resolute in our commitment to vigorously oppose this 61m tower at 4300 Aspdin Road, including at the municipal level.

It is because of the significant negative impact to the scenic views of the north shore of Skeleton Lake that the SLCO stands opposed to the current proposal for a 61m tower at 4300 Aspdin Road. The SLCO is willing to work with Bell to develop a mutually agreeable plan which could involve a 30m “monopine” style tower in the same location or two strategically placed 30m towers if that is required. This type of tower is similar to those that you’ve indicated Bell Mobility is installing in many areas of Muskoka and that Bell is required to use in other scenic areas of Ontario, such as Algonquin Park. This style and size of tower is more environmentally and aesthetically compatible with the Skeleton Lake community’s desire to protect and preserve the natural character of the Lake and its scenic vistas.

I'm writing to you in my capacity as the President of the Skeleton Lake Cottagers Organization (SLCO). Our organization represents more than 500 owners of waterfront properties and more than 1000 families in our immediate watershed. Our mandate is to preserve and protect our very unique and scenic lake and its environs. We are guided by our Lake Plan and Stewardship Program (the ‘Lake Plan’), a copy of which can be found at our website. (https://skeletonlake.ca/Lake-Plan)

As you know, members of the SLCO attended Canacre's video question & answer meeting on Nov 19th, 2020 regarding the above proposed tower. I believe hosting that meeting was a necessity under federal regulations to gain approval for Bell Mobility’s application for a proposed telecommunications tower, dubbed ‘Skeleton Lake North W7716’ (the ‘Tower’). We only received notice of that meeting on Nov 17^th, courtesy of our Ward Councilor in the Township of Muskoka Lakes. We expected a meaningful engagement where concerns would be heard and alternatives considered. We were disappointed to find that was not the case, that Canacre was simply passing on a cursory and incomplete outline of Bell’s intentions.

If you refer to page 15 of our Lake Plan you will see a ranking of the values that our community constituents decided are most important to them. In particular, you will notice that some 97.5% of our community values “Scenic Views” as the second most important “Valued Feature”, behind only Water Quality.

Your proposal for a 60.8m tower, proposed to be erected within 700m of the shore of our scenic Skeleton Lake on the highest pinnacle known as our famous ‘Tomelin Bluffs’, will tower some 120m (or 393 feet) above Skeleton Lake.

The placement of a tower this size, in this location, is completely incompatible with our community’s desire to protect scenic views around Skeleton Lake, designated as an extremely high priority by our constituents.

In addition, we are concerned that Bell may have made a serious omission by overlooking the very important fact that Skeleton Lake has a registered water aerodrome on it. In your presentation of Nov 19^th, you promised that the tower would not require lighting, however we believe Transport Canada may decide otherwise due to this aerodrome. Dark skies are another highly rated Valued Feature by our community and having a lighted tower will negatively impact this.

While our community, like many other rural communities, is in dire need of improved internet access, we want solutions that do not completely and utterly compromise the most cherished qualities of our lake community. Based on the initial due diligence and research by our Board of Directors, we are aware that other alternatives are becoming available.

We are asking for a delay in the ‘Consultation’ phase of this proposal until such time as we can have meaningful dialogue with the business team from Bell Mobility responsible for this tower proposal and the general network topology in Muskoka, and have our concerns and our needs duly considered.

We would also like time to consult our own community for their input.

We believe we have grounds to seek this as we were not properly served notice, despite the fact that i) the community shares the lake which is within the 1km notice radius and, ii) the township has been in possession of, and acknowledged, our Lake Plan since 2015 and should have included the SLCO early on in the discussions.

In the meantime, we are seeking some additional information including:

When did Bell first notify the township of this application?
What engagement has Bell had with the residents and cottagers of Skeleton Lake and when?
Why was the SLCO not notified at an early stage, knowing the potential impact on scenic values and sight lines in and around our lake?
What is Bell’s expected date to have approval to proceed with this tower?
When does Bell expect to commence construction?
When does Bell expect to commission the tower into operation?
Why can Bell not consider lower and less intrusive ‘mono-pine’ towers for improving our service? These are common practice in Muskoka.
How many potential subscribers would be eliminated if Bell used a 30m ‘mono-pine’ tower, similar to that proposed for W7723 on the south side of the lake, instead of a free-standing 61m steel lattice tower?
If Bell cannot, is it because this tower also serves to ‘bridge’ Bell’s fibre optic network available along Aspdin Rd to other towers via a microwave or similar point-to-point link? If so, are these receivers in existence now or planned for the future?
Bell has equipment on multiple towers serving Skeleton Lake already, identified as; W1736, W1463, W3418 and LBHONW0093-1S2. Only two of these towers, W1463 and LBHONW0093-1S2 currently have the 3500Mhz WTTP radios installed. What are Bell’s plans to install WTTP radios on the other two towers, W1763 and W3418? How many more subscribers will be reachable from these? Will installing WTTP radios on these eliminate the need to reach 61m at W7716 Skeleton Lake so that a 30m ‘mono-pine’ tower would suffice?
We are aware that a 3^rd-party tower operator that Bell sometimes uses, SBA, is proposing a new tower just 2500m to the west of Bell’s proposed site. Why can’t Bell lease space on this tower to implement its WTTP service?
Is Bell willing to make a binding undertaking that tower lighting will NOT be required on W7716 Skeleton North?
At your meeting, we asked for a rendering of the tower from the perspective of the lake. You said it was not possible. We have had several created, to scale. I have attached a few of these for your information and comment. We intend to use these in discussion with our community.
Can you establish a meeting for us with the appropriate Bell executives and key decision makers on this project?
Finally, can you please provide the SLCO with contact details of the key individuals and business leaders responsible for this project at Bell Mobility and Bell Residential Services. We wish to engage with them on this proposal.

We look forward to receiving your answers to these questions to better understand and give our opinion on this proposal. In addition, we look forward to Canacre Ltd. facilitating a meeting with Bell Mobility.

In closing, we are not against Bell expanding coverage in our lake community. We’ve been wanting improved service for more than a decade. However, we want to engage with Bell in finding a win-win solution inclusive of the community, the municipality and Bell together. Our community wants better internet connectivity and acknowledges Bell’s movement in that direction. We just want to find a solution that fits the values and goals of our very unique community.

The Township of Muskoka Lakes held a virtual meeting on Sept 26th to review the Policy Directions for the new Official Plan. It was overwhelmingly attended by Skeleton Lake cottagers, underscoring our concern for protecting the fragile environment in Muskoka and in particular our pristine lake.

We want to make sure, once we finally bury Lippa's planned quarry, that there will never again be an opportunity to establish a harmful Pit & Quarry or any other harmful industrial site near our precious lakes.

So I'm asking you to make sure you take some time this week to complete the survey regarding the Policy Directions that will shape the actual policies in the next Official Plan due to be drafted in early 2021. The deadline for the survey is this Friday, October 9th.

Here's what we want the new OP to reflect:

Recognition that the effects of a Pit & Quarry FAR exceed the physical footprint of the operation itself.
That NO operations related to quarrying should EVER be located closer than 2km to a waterbody in Muskoka. That includes, extraction, effluent discharge (de-watering), material hauling, destruction of natural environment and heritage features - not just crushing!
Noise from trucks, harmful effects of dust, road safety and the peaceful coexistence of communities must ALL be considered for any Pit & Quarry application near a waterfront area.
Pits & Quarries should be restricted to an area adjacent to the two main arteries leading back to the major markets of southern Ontario, specifically Highways 11 & 400. This is compliant with the Provincial Policy Statement. Since granite is found everywhere in Muskoka, there is NO strategic reason to locate Pits & Quarries near sensitive lakes, streams and natural reserves deep in the interior of Muskoka along scenic township roads. Highways 11 & 400 were designed to avoid communities and sensitive natural areas.

The survey will take about 10-15 minutes to complete, and you should review the Policy Directions document as well if you haven't already. In the survey, make sure to select "Mineral Resource Uses Adjacent to Waterfront Area" in Question 2 and fill in your comments as above in Question 3.

You can also choose to comment on other areas that are important to you, the community and our lake such as; Lake System Health, Recreational Carrying Capacity, Watershed Planning and Cumulative Environmental Impacts - all important and all impacted by quarrying.

This email is primarily directed to all boat storage, parking & docking customers who have been storing their boats at Troy Cove Marina, now known as The Village Harbour Marina.

I am pleased to announce that at this time we have professional mechanical staff who have vast experience in the marina business, and are now ready to winterize, wrap and store your boats.

Unfortunately at this time the marina is closed in terms of selling gas and convenience store. However, should anyone need help, emergency gas or mechanical service we can help, please call us at 416-580-0352.

For the 2021 season the marina operation, gas bar and store hours will be open 7 days a week during summer season from 9am till 6pm. Also we will be providing professional licensed mechanical service.

I apologize if this delay has caused you any frustration. I can assure you we are going to make this marina a beautiful place to come visit and do business for well into the future.

Since I took over this role (2-3 weeks ago), I have been wrestling with a limited database of customers which was left behind by the previous renter.

I kindly ask that you please contact us with your name, telephone #, email address, boat slip number (photo would work) and a brief description of your craft. This information will vastly help our mechanics organize each craft that is ready for pulling out of the lake.

For Immediate Release! Summer Events Cancelled due to COVID-19

At our May 15^th Board meeting, the SLCO Board of Directors made the difficult decision to cancel all of its summer events due to the ongoing pandemic and social distancing requirements. This includes the Regatta, Sailing Race, Family Day and Bugs in the Mud.

We realize many of you will miss the annual fun and social events. However, our Recreation Committee is considering alternative activities and virtual contests that can be held while observing social distancing rules. If you have suggestions of your own for such events please forward them to our Recreation Director Bob Smith at bob.smith@skeletonlake.ca.

While many of you start to venture back to the lake, please observe the current fire regulations and respect the local health recommendations. Stay well, stay safe.

Case Management Conference 2 Postponed - Proposed Lippa Quarry

Case Management Conference re Proposed Lippa Pit & Quarry

As advised in my last communique, a Case Management Conference (CMC) took place on Thursday, November 28 in Port Carling. A big thank you to everyone that attended the CMC. Once again, we filled the hearing room, a clear demonstration of the community’s continuing opposition to the quarry.

For those that were unable to attend, the CMC was procedural in nature. None of the substantive issues were discussed. Instead, the following key points were discussed or agreed upon:

The Skeleton Lake Cottagers Organization (SLCO) and several others requested Party status on the second appeal; this will be decided at the next CMC.

46 people requested and were granted Participant status on the second appeal. It is proposed that SLCO’s lawyer will draft a joint statement that these participants may sign, although some participants may prefer to prepare their own written submission.
There was discussion about what rules govern the two appeals.

A list of issues is to be agreed to by the Township of Muskoka Lakes and Lippa prior to the next CMC.

The next CMC will occur on Wednesday March 25, 2020 in Port Carling. It is scheduled to be in-person, but if sufficient progress has been made the parties could hold the CMC by conference call.

We will continue to keep you advised as more information becomes available. In the interim, please feel free to contact me with any questions you may have. Again, thank you for the strong support at Thursday’s CMC.

On September 20, 2019 the Province posted a proposal to amend the Aggregate Resources Act (ARA) through ERO 019-0556. Comments are due by November 4th, 2019 (45 day posting).

The SLCO is monitoring these developments and will be making a submission through our legal team before the deadline. We will distribute that once available.

It's worth noting that these changes are still preliminary and somewhat vague. We expect more specific information to be made available and an opportunity to fully understand the impacts and to provide additional input to the process.

We have been asked by several members if it's important to make a submission. While it's questionable as to whether these changes could affect our current fight with Lippa, we nevertheless expect future threats in our watershed and therefore feel that, yes, it is important for our community members to submit their comments.

In order to help with your submission, we have posted two documents to our website that might be useful. One is a submission from the City of Hamilton that gives an overview and captures fairly well our own position on what has been presented so far. You can find that by clicking here.

President's Thanksgiving Message

If you're like my family, you'll know Fall is perhaps the best season to be on the lake. And I'm reminded when Thanksgiving Weekend comes around of how lucky and thankful we are to be able to share this wonderful paradise with such a caring and concerned community.

As your new SLCO president I want to take this opportunity to introduce myself and to say thanks to Scott May for his time and dedication over the last three years as our president and for being a champion in the fight to protect our lake. I'm also thankful that Scott won't be going very far and will be my wingman, serving as Vice President. We have a lot to do over the coming 24 months.

This past August we elected a slate of 15 directors to the SLCO Board of Directors; many veterans and some new faces. I'm very proud of the skills we have on our Board and the determination of them all to protect our lake. You can find our Board members at Board of Directors.

Your SLCO Board meets many times during the year to review programs and progress and we just wrapped up our last formal meeting for 2019 yesterday. The Board members chair many committees which will also meet several times per year and rely heavily on the involvement of other volunteers around the lake. You can find information about our committees here Committees.

This coming year will be a watershed year for us. We have a major battle looming on the horizon that will test our collective strengths. But we also have to 'mind the shop' and keep all our other activities aimed at protecting our lake and fostering community ticking along. At the conclusion of our meeting yesterday we prioritized our objectives over the coming year as follows -

Defeat the proposed Lippa Pit & Quarry
Build a strong Membership
Fundraising
Focus on Stewardship

How will we know when we've accomplished these objectives? When our membership is over 300, when we reach $200,000 in donations and when we successfully shut down the proposed Pit & Quarry that threatens all that we consider sacred about our lake.

Our focus on Stewardship is our raison d'être. While we are being challenged by commercial development, we have to keep striving to roll out the actions and stewardship programs identified in the Skeleton Lake Plan & Stewardship Program.

You'll be hearing quite a bit from us over the coming weeks and months. The provincial LPAT (formerly OMB) will be holding a Case Management Conference (CMC) on the 28th of November to discuss how to proceed with the multiple appeals launched by the Lippas. The meeting will again be held at the Town of Muskoka Lakes municipal chambers in Port Ccarling starting at 11:00 a.m. and we will need a strong turnout to ensure the Township and the adjudicators know we won't be bullied into submission. The SLCO Board will be hard at work preparing for that next confrontation.

In the meantime, our very best wishes for a joyous and relaxing Thanksgiving Weekend with your loved ones.

Peddle Boat Raffle

The Skeleton Lake Marina has kindly donated a new peddle boat to be raffled. Raffle tickets can be purchased for $5/each or 3 tickets for $10. Water Walk

On June 29 & 30, there will be an ‘All Nations Skeleton Lake Water Walk’ around Skeleton Lake, led by First Nations women, to show respect and care for the lake and surrounding watershed. You may walk both days, or for any shorter distance. There will also be a sunrise ceremony at 113 Long Point Road in Utterson on the Saturday morning that you are welcome to attend. Erin Dixon, a Métis woman, with longstanding family ties to Skeleton Lake, has been instrumental in organizing this Water Walk. Erin will be one of the women leading the way on the walk. Free ‘Waste Management Flood Vouchers

Oops - We previously announced the Town of Huntsville had arranged for a dumpster to be placed on Camp Newport road on June 1 & 2 for people to put solid floating waste into from the spring flood. Unfortunately, the bin was never delivered by the contractor. Our apologies to anyone that showed up with lake waste, only to find no bin! Instead, the Town of Huntsville has made available free ‘Waste Management Flood Vouchers’ which are valid until July 2, 2019. They can be picked up inside the Skeleton Lake Marina at the desk during normal business hours. (Note: the marina is not involved with the collection of spring debris. Instead the marina is kindly acting as the distribution point for the vouchers.) A big thank you to both the Town of Huntsville, and the Skeleton Lake Marina.

As communicated in my May 5 note, the Town of Huntsville is moving forward with recovery efforts from the spring freshet, collecting and removing the debris in our lakes and rivers. The Town has partnered with several lake associations to finalize an approach for watershed clean-up. Specifically, they have arranged for a dumpster to be placed at each lake for one weekend. For Skeleton Lake, a dumpster will be located at 180 Camp Newport road on Saturday June 1 & Sunday June 2. Guidelines for use of the dumpster are as follows:

The bin will be an ‘Aces Waste’ dumpster, orange in colour
Only man-made, floating items are to be retrieved from the lake and deposited in the dumpster
If floating items are too large to be placed in the dumpster, the item is to be placed beside the dumpster (the Town of Huntsville will ensure the items are placed in the dumpster)
No trees or natural vegetation, such as foliage or shrubbery shall be deposited in the dumpster
No debris collected from the land is to be deposited in the dumpster
No household garbage is to be deposited in the dumpster
The Town of Huntsville will cover the costs associated with the dumpster

Additionally, if you sustained property damage, supports are currently available as follows:

Tipping Fee vouchers are available from the Town of Huntsville. These vouchers can be picked up at the Town Hall or the Canada Summit Centre

A short note on the 2019 spring flood. First, on behalf of the SLCO Board, I hope you have not been personally affected by this year’s spring run-off and flood. We recognize many residents in Muskoka have suffered damage to their property.

We have received a communication from the Town of Huntsville that they asked us to share. They are advising that collecting and removing the debris in the lakes and rivers will be a key focus for the Town. It is their hope that they can partner with the Lake Associations to finalize an approach for watershed clean-up. It is the Town’s goal to reach out to organizations shortly so they can begin these discussions. In the interim, they have asked lake associations to share the following information with their membership:

The Town of Huntsville will be working with the lake associations to collect & remove debris from the lakes and rivers
Residents are encouraged to not try and retrieve floating items at this time
Should you see a large item (e.g. larger than a Muskoka chair) floating in our watershed, please call 705-789-6421 ext. 0 and the town will assist with securing it until such time as it can be collected

2019 Muskoka Stewardship Conference

Spring has arrived (well sort of, if you ignore all the snow currently in Cottage Country) and so has the 2019 Muskoka Stewardship Conference.

This year’s Stewardship Conference is about how the living parts of our unique watershed are all connected to function as one living ecosystem that serves our needs and enhances our lives. Attendees will hear from the experts on the basics of watersheds, how all the parts function together as a living ecosystem, the benefits from keeping this ecosystem healthy and what is needed to achieve this. There will also be an opportunity to have your questions answered by the experts.

The Conference will take place at the Active Living Centre in Huntsville, from 9:00 am – 4:30 pm on Friday April 26. Tickets are only $60/person. Please refer to the flyer below.

Lippa Quarry-Motion to Dismiss Decision/Continuation of Objections, PHC 3

At the 3rd OMB Pre-Hearing Conference (PHC) last November, Ross Earl made a ‘Motion to Dismiss’ the Lippa application, which was strongly supported by SLCO. At the time, a decision on the Motion was reserved by the Adjudicator. That decision has now been issued, on 5 March 2019. In summary, the Tribunal ordered the motion to dismiss the appeals be denied, which is unfavourable to SLCO’s case. Full details of the decision can be found by clicking here.

On a positive note all Parties agree that a further Official Plan Amendment Application is required to address the issue of Lambert's Lake and Mud Lake being within 2 kilometres of the proposed rock crushing operation, which is prohibited under the Township of Muskoka Lakes Official Plan. This is good news because it recognizes the significance of the issue at hand, and we are well-positioned to fight this new application.

Re: Continuation of Objection Letters - Proposed Lippa Pit and Quarry

This is a follow-up letter on the topic of Objector Letters. In my communication of February 13, I informed members that if they continue to have objections to the Lippa Quarry application and are not satisfied by the information in the package from John Ewart (lawyer for the Lippa family), they are required to provide a second letter to keep their Objector status, either by personal delivery, by registered mail or by e-mail.

If you have submitted an objection letter in the past, we urge you to take a few minutes to re-submit and update your letter of objection. This second letter needs to be delivered to both the Applicant and the MRNF by Friday March 8, 2019, which makes e-mail the preferred method of communication. Note that an e-mailed objection that does not contain a valid postal address (i.e. a street address, not a PO Box) will not be considered acceptable.

A number of people reported having difficulty retrieving these reports from the Skelton Brumwell site (Lippa’s engineering firm), including our experts. Two requests to Lippa’s lawyer to extend the deadline have gone unanswered.

We instructed our experts to prepare submissions to the Ministry of Natural Resources and Forests (‘MNRF’) to respond to the updated technical reports submitted by Lippa’s consultants. According to our experts, here are just a few of the deficiencies in the reports:

Water Quality

1.    It has not been demonstrated Skeleton Lake, an ultra-oligotrophic (or ultra-clean) body of water, will be protected.  This is a bottom line for residents.

2.     Lippa’s consultant disagrees with Ministry of the Environment Conservation and Parks (formerly the MOECC) conclusion that Skeleton Lake has a high phosphorus sensitivity.  This is contrary to the findings of our very highly regarded water experts.

3.     Proposed mitigation measures such as diffusing discharge of phosphorus and implementing new Stormwater Best Management Practices are not clearly defined, and no comments or approval is indicated from MOCF.

4.     The technologies proposed to treat the phosphorus laden effluent water are designed to trap fine suspended particulate and reduce phosphorus suspended in water.  There is no assurance this will have any significant effect on phosphorus entering the lake.

5.    Dissolved phosphorus is a primary concern for Skeleton Lake because the rock Lippa proposes to blast and crush is high in phosphorus.

Noise Impacts

1.    Noise impacts are a still a significant concern.  In fact, along Butler Mill Road, they will be enormous (22dB) increase in noise over the status quo on the lake.  That’s like sitting in your living room with a quiet dishwasher running (40-45 dB) vs. having someone turn on the television in your living room so loud you can’t carry on a conversation (60-65 dB).

2.     Our expert predicts the noise will be so disruptive, our quiet community will be downgraded from an acceptable noise impact area from a quiet rural rating Class 3, to a Class 2 or 1 area, equal to an urban or suburban noise zone.  This would be like moving from a very quiet Skeleton Lake (Class 1) to a street near a busy intersection e.g. Leslie and Finch Ave., Toronto.

3.     The updated acoustical report lacks basic information which makes it difficult assess the impacts.

4.     The mapping is not clear enough to identify all of the affected neighbours.

5.     Missing factors along the haul route such as gradients (hills) in the road leading to the quarry means that the quarry is potentially 5dB louder than predicted.  There is a very high potential that people are going to be woken from their sleep!

6.     No analysis is presented whether or not the haul route selected is the route that most minimizes noise impacts for residents and the environment.

7.    The hours of operation mean it is likely loud trucks will begin at 5:45 am, with trucks sitting outside the quarry gate idling.

Traffic Safety

1.    Based on a review by a qualified traffic safety engineer retained by SLCO, we are of the opinion that the safety of the haul route has not been fully assessed.

2.     Specifically, school bus operations and truck traffic interactions have not been fully assessed, we can’t be sure our kids are safe.

3.     Intersection, curve and hill sightlines have been identified as deficient (possibly unsafe) along the proposed haul route corridor but have not been addressed in terms of improvements to the road needed.

4.     The proponent’s safety consultant concluded that the 80 km/h posted speed is not appropriate for the roadway geometrics and operations, which raises the clear question of whether 80 km/h is too fast to be safe for heavily loaded aggregate haulers.

5.     In addition, the Lippa’s safety consultant concludes that there have been only two collisions along the haul route over a five-year period.   According to our expert, this frequency seems extremely low for even the best performing rural roadway over a 5-year period.

6.    The increase in collision potential due to slower moving trucks has not been quantitatively assessed and therefore it is unknown if it poses a risk, which is a legitimate concern for people sharing the road with these new trucks.

Land Use Planning

1.    The Township and SLCO remain opposed to the application, including the aspect of crushing within 2km of a waterbody.  If the Township and subsequently the LPAT prohibits the crushing, the operation changes significantly and all of the related reports would need to change.

2.     We question if a pit in this remote location is viable if the raw aggregate must be shipped somewhere else for processing before being shipped to market.  This is a lot of travel on our roads that may pose an unnecessary traffic safety risk.

3.     Until this matter is resolved, it seems premature for any agency or impacted resident or First Nation to provide final comments on the application.

4.     The Official Plan states:

a. 14.7 The siting of an Aggregate Pit should be based on the following criteria, in addition to all requirements of the Aggregate Resources Act:

· Site is located on an arterial or major collector road capable of handling the increased traffic and haul loads;

· Site is in close proximity to a provincial highway.

5. In our opinion, the site meets neither of these criteria and these policies. These policies are intended to prevent the traffic safety issues that have been identified above.

You might find these points helpful as you draft your letter. In parallel, SLCO is preparing its own letter of objection, based on these points, which we will circulate to the SLCO membership as soon as it is available.

As advised in my last communique, the 3rd OMB Pre-Hearing Conference (PHC) took place Monday in Port Carling. A big thank you to everyone that attended the PHC. Despite the adverse weather conditions we filled the hearing room, a clear demonstration of the community’s continuing opposition to the quarry.

At the PHC, Ross Earl made a ‘Motion to Dismiss’ the Lippa application, which was strongly supported by SLCO with filed affidavits and legal arguments. A decision on the Motion was reserved by the Adjudicator and is unlikely to be rendered before mid to late December.

I am pleased to also advise you that opponents of the quarry recorded a significant win at the PHC. Ross Earl has consistently maintained that the Official Plan prohibits rock crushing within 2 kms of a “Waterfront Designation”; that Lambert’s Lake and Mudd Lake are “Waterfront Designation”; that the proposed quarry and associated rock crushing operations are within 2 kms of these lakes; and that the Lippa application therefore violates the Official Plan. This position was supported at the PHC by the Township and by SLCO; and at the PHC, counsel for Lippa conceded to the Adjudicator that this position is correct. As a result, Lippa can in no circumstances proceed with their application unless they also apply for a second amendment to the Official Plan, to allow rock crushing within 2 kms of Lambert and Mudd Lakes. This amendment would be the subject of another time-consuming round of public consultations and would then have to be presented to Township Council. Our expectation is that this amendment would be rejected by Council, consistent with their rejection of the amendment proposed in the original application.

A reminder that the 3rd OMB Pre-Hearing Conference (now called LPAT CMC) will take place at 10:00 am on Monday, November 26, 2018 at the Municipal Office, 3 Bailey Street, Port Carling. It will be a Hearing of a Motion to Dismiss the Lippa Appeal, which Motion is being brought by Ross Earl and is being supported by SLCO. Grounds for the Motion are that the Lippa Appeal is frivolous because of a flaw in the original application. Specifically, Lambert’s Lake (where Mr. Earl owns property) and Mud Lake are less than one kilometre from the proposed rock-crushing operations on the Lippa site. Both lakes are designated “Waterfront” under the Township of Muskoka Lakes Official Plan; and that Plan forbids any new rock-crushing operations within two kilometres of property designated “Waterfront”. As a result, the Lippa proposal violates the Official Plan.

Given the important issue to be decided at Monday’s hearing, your attendance is especially important. We need to continue to demonstrate to the adjudicator that a large number of people remain strongly opposed to the proposed pit and quarry.

The Tangled Garden Premiere

A reminder that the premiere of ‘The Tangled Garden’ will be on Sept 1 at 7:00 PM at the Rosseau Memorial Community Centre. It is a new play written by Skeleton Lake's own Bruce Gooch about two unlikely people brought together by poetry and ultimately connected in life and death. Catch this debut performance starring our own Lynn Vogt and Bruce Gooch before it heads to Europe for an extended run this Fall. The cost of a ticket is $25 (which will be donated to the SLCO 'Stop the Lippa Quarry' Fund). Cookies for a Cause!

Last weekend the Stroud grandchildren hosted a cookie and drink sale to raise funds and awareness to fight the proposed Lippa quarry. A group of six children from the north shore of Skeleton Lake raised over $650 for SLCO’s Stop the Lippa Quarry Fund, by selling homemade cookies and lemonade. The sale was set up at the corner of Long Point Road and Leander Road. They proudly presented this money to Scott May, SLCO President, at the AGM on Sunday August 12. Now that’s an impressive effort to help preserve our beautiful lake!

The purpose of this letter is to inform you of recent activity, plus important upcoming dates in our continued fight against the proposed Lippa pit and quarry.

Recent Activity:

The 2nd Ontario Municipal Board (OMB) Pre-Hearing Conference was held on Friday July 13, 2018 in Bracebridge. A big thank you to all of those who were able to attend - once again, the Community Centre was filled with people opposed to the Lippa operations! During the Hearing, the Tribunal added an additional Party plus 3 additional Participants to the case, all supporting our position.

As well, during the Hearing, SLCO Counsel asked the Township of Muskoka Lakes to clarify its position on Lambert’s Lake and Mud Lake, which are designated as Waterfront in the Township’s Official Plan. The proposed pit and quarry would be located significantly less than two kilometres from these lakes, which is in violation of the Official Plan. We hope to receive their response by August 31, 2018.

Upcoming Dates:

The Board has ordered that a 3rd OMB Pre-Hearing Conference be set for Monday Nov 26, 2018 and be held at the Community Centre, Port Carling. As before, your attendance is important, as we want to continue to demonstrate to the Adjudicator that a large number of people remain strongly against the proposed pit and quarry.

The OMB Hearing itself is expected to take place sometime in 2019. These dates will be set at the next PHC and we will notify you once they become available.

Water Quality Update

Water quality testing was conducted on July 7, 2018 (the previous test was conducted on May 31, 2018).

There are six parameters that our water testing program monitors. They are Total Coliform, E.Coli, Total Phosphorus, Calcium, Clarity and Temperature. All of these have a factor in the quality of our water.

Water samples for Total Phosphorous and Calcium are done and sent to the Dorset Environmental Science Centre for testing. We will receive results for these later this summer. Dorset also receives our secchi (clarity) results for the season.

Secchi testing (clarity) on July 12, 2018 (a very sunny, calm day) resulted in a count of 11 meters. This is an excellent result for clear Skeleton Lake.

8 Locations are tested May to September each year for Total Coliform and E.Coli:

Wilson’s Bay SK2

Newport Beach SK4

Beaman’s Bay SK6

Camp Ramah SK7

Bottom of High Falls SK8

Camp Kwasind SK9

Long Point Bay SK10

Long Bay SK11

All of these locations in the second testing (July 7, 2018) tested “good to great”. Total Coliform counts were higher than in May. This is common for the lake with warmer temperatures and more boating. There has not been a lot of rain and the pollen was very high/thick this year. Temperature of the lake is a consistent 77 degrees Fahrenheit.

Our water testing so far this year indicates that the high quality of the water in Skeleton Lake continues its reputation of a crystal, clear clean lake.

Garbage

The garbage and recycling bin site located at Skeleton Lake Marina did not return this summer season. The owner of the Marina requested that the District of Muskoka (District) remove the site due to ongoing misuse of it and the continued challenges of keeping the site clean and tidy.

Instead, for those interested, the marina has arranged a new service. New bins are now available to use at the side of the marina in a fenced, locked area. The current cost per month to use the bins is approximately $25/month. The amount of the fee is based on the number of people who use the garbage service. The marina will not be using these bins and will not be making any profits on the program. Please note this new service is only open to the marina’s seasonal slip customers, and not open to the general public.

Septic Pump-Out

SLCO is planning to once again organize a ‘septic tank pump’ for water access properties. This activity was done 2 years ago. For those of you that might have missed it in 2016, now is the perfect time to get this necessary job done. You can update your profile page by signing into your account at https://skeletonlake.ca/Sys/Profile , choose the grey tab ‘edit profile’ where you can indicate your interest in a pump out this year. Alternatively, you can email admin@skeletonlake.ca to indicate your interest in a pump out. We will be sending out more details in a separate note.

Nesting Loons

The cry of the loon is a classic sound of life at the cottage. As such, we need to do what we can to help protect our feathered friends. A friendly reminder to please slow down on the water. In particular, please be aware of the loons in the narrow channel between Rosebud Island and the mainland. There is a sign at one end that says ‘slow no wake’, and there is a sign at the other end that says loon nesting area. Speeding close to shore hurts our wildlife, damages boats and docks, and is dangerous!

Annual Regatta

The annual regatta will be held on Saturday August 4, 2018 starting at 12:00 noon. Similar to before, it will be held at Newport Adventure Camp, on Camp Newport Road.

Activities will include swimming/canoe/kayak races, plus land competitions including a 3-legged race, wheelbarrow race and tug-of-war. There will even be a horseshoe social. In-between the events, there will be a BBQ to keep you fueled up. BBQ and registration will start at noon. The event will end at approximately 3:30 PM. In the event of rain, the Regatta will be held on Sunday, August 5. The regatta is free to all SLCO members, their family and weekend guests.

Fishing Derby

The fishing derby will be held this year on Saturday, August 4 from 9:00 am – 12:00 noon at the Skeleton Lake Marina, at Skeleton Lake Road #3 and Highway 141. A pancake breakfast will be served, along with an award presentation after the event for those skilled anglers!

Sailing Regatta

The 49^th running of the sailing regatta will be held on Sunday, August 5 with a start time of 1:30 pm at the east point of Wilson's Bay. In the interim, let’s hope for fair winds!

2018 AGM

A reminder that the Annual General Meeting will be held this year on Sunday August 12. The meeting will start at 10:00 am, and be held at Camp Ramah, 1104 Fish Hatchery Road in Utterson. Please plan to attend in order to keep you informed of both current activities and issues on the lake.

Proposed Lippa Quarry

The 2nd Ontario Municipal Board (OMB) Pre-Hearing Conference (PHC) was held on Friday July 13. A big thank you to all who attended!

The 3^rd OMB PHC is scheduled for Monday November 26 in the Township of Muskoka Lakes Council Chambers (1 Bailey Street, Port Carling), starting at 10:00 am. This PHC provides an excellent opportunity for us to continue to show the OMB our level of concern and our complete commitment to defeating this quarry. Let's fill the Community Centre Hall with concerned SLCO members and others in the community.

OMB / Lippa Pre-hearing Conference Confirmed for Friday July 13th - An Update and Issues

The SLCO is confirming that the Pre-hearing Conference ("PHC") is proceeding this Friday in Port Carling at 10:00am as scheduled. We hope to see a big turnout.

There will be several controversial items on the agenda at the PHC, which SLCO is monitoring closely.

The lawyer for Frank and Elizabeth Lippa ("Lippa") will be asking the OMB to schedule a hearing date as soon as possible. Our lawyer will be objecting because the Ministry of Natural Resources and Forests ("MNRF") has not formally referred the case under the Aggregate Resources Act for a hearing. Our letter of objection sent to the MNRF dated July 10, 2017 has not received a response. ThePlanning Act appeal and the ARA license should proceed together, but not until MNRF has completed its consultation and provided SLCO and the Township with its responses to our objections and any updated technical reviews. Please note that Mr. Frank Lippa passed away recently and we are waiting to learn who will be the proponent going forward.
Mr. Ross Earl obtained party status and has notified the parties that he is a landowner on Lamberts Lake, just northeast of the proposed quarry. Another lake, known locally as Mud Lake also lies close to the proposed quarry. Both lakes are designated "Waterfront" in section "F" of the Township Official Plan. Official Plan section E.14.2 requires new rock crushing operations shall be limited to areas "farther than two kilometres from a Waterfront designation". Both Mr. Earle and SLCO will be making arguments on Friday that the failure to address the lack of physical separation of the quarry from these lakes requires a re-submission of the application to acknowledge these designations and to require examination of the impacts to these lakes, leading to their protection.
SLCO will be objecting to the draft "Issues List" provided by counsel to Lippa. The List is too general and vague to permit the parties to ascertain what evidence, if any, needs to be called in response to the Lippa case. It is premature to proceed to a hearing without a detailed Issues List. We are expecting the Township to support SLCO in this objection.
Finally, SLCO will be seeking full disclosure of any new technical studies provided to the MNRF for review by our experts. SLCO has been diligent in retaining experts from numerous disciplines to ensure the quarry is either not approved, or at the very least will not impact the quality of life around the lake. Our experts have indicated in a series of preliminary peer reviews that there are serious deficiencies and omissions in the technical reports submitted to date. In layman's terms, the facts are noise from the quarry and truck traffic will disturb our tranquil and natural environment. Traffic safety mixed with the addition of large trucks is a significant concern as local roads are a "five out of five" for safety concerns. Water quality could be impaired so that the lake will not persist in the same quality we now enjoy. I expect that once our experts have made a thorough review of the updated studies, we will be providing you with a full report of their findings. Again, we expect the Township to support our disclosure request.

The PHC will take place in the Port Carling Community Centre, starting at 10:00 sharp. We expect the entire proceeding to last no more than 1 hour, please spare the time if you can. Our strength is in our community and our numbers.

Water Quality

Water quality testing was conducted on May 31, 2018.

There are six parameters that our water testing program monitors. They are: Total Coliform,

E. Coli, Total Phosphorus, Calcium, Clarity and Temperature. All of these have a factor in the quality of our water. Water samples for Total Phosphorous and Calcium are done and sent to the Dorset Environmental Science Centre for testing. We will receive the results for these samples later this summer. Dorset also receives our secchi (clarity) results for the season.

Secchi testing on May 31, 2018 (a very sunny, calm day) resulted in a count of 11 meters. This is an excellent result for clear Skeleton Lake.

8 locations are tested May to September each year for Total Coliform and E. Coli:

All of these locations in the first testing (May 31, 2018) tested very well. There had not been a lot of rain, and not a lot of spring runoff due to our late spring and no pollen. Our water testing so far this year indicates the high quality of the water in Skeleton Lake continues its reputation of a crystal clear clean lake.

Proposed Lippa Pit and Quarry – Update

The purpose of this letter is to inform you of recent news, and its resulting impact on the legal process of the proposed quarry just north of Skeleton Lake.

I recently learned of the tragic news of the sudden passing of Mr. Frank Lippa, the quarry applicant.

It is currently unclear how this unforeseen event may impact the timing of the second OMB Pre-Hearing Conference that was to be held in Port Carling on July 13. The ‘Rock the Quarry Rally’ for Skeleton Lake, previously scheduled for July 13 in Port Carling, has been postponed until sometime in August.

Further updates will be issued as new information becomes available. Until then, our thoughts and prayers go out to the Lippa family during this difficult time.

The purpose of this letter is to inform you of recent activity, plus important upcoming dates in our continued fight against the proposed Lippa pit and quarry.

Recent Activity:

Over the past few months, our team has been working with some of our experts to support our case. Specifically, initial assessments have been made by water quality, acoustics and road safety experts.

Key Dates:

The second Ontario Municipal Board (OMB) Pre-Hearing Conference (PHC) will take place on Friday July 13, 2018 at 10 am and be held at the Municipal Office, 1 Bailey Street, Port Carling. Your attendance is important, as we want to continue to demonstrate to the Adjudicator that a large number of people are strongly against the proposed pit and quarry.

Later that same day, Friday July 13, from 7:30 – 10:00 pm, a ‘Rock the Quarry Rally’ for Skeleton Lake will be held in the Port Carling Community Centre. Both guest speakers and live musical entertainment will be on hand. Admission will be free and open to the public, (however donations for SLCO’s Stop the Lippa Quarry Fund will be gladly accepted!) This rally will be informative and entertaining so please plan to attend. 2018 Muskoka Summit on the Environment May 24 & 25 - Bracebridge

The 2018 Muskoka Summit on the Environment will be held on May 24 & 25 in Bracebridge. These summits, occurring every 2 years since 2010, have become premier events featuring world-class speakers and public debate on key environmental issues. This year's theme is "Restoring our Relationship With The Natural World".

On the second day, all speakers participate in a panel discussion moderated by Paul Kennedy, host of CBC Radio's "Ideas". He uses the panel discussion and excerpts from the rest of the Summit to create an hour-long radio presentation that is broadcast on "Ideas".

The purpose of this letter is to provide you with a brief summary of last Wednesday’s Ontario Municipal Board (OMB) Pre-Hearing Conference (PHC), held in Port Carling.

The first PHC proceeded as planned. Mr. Hugh Wilkins was the Adjudicator for the OMB. Approximately one hundred people attended, which demonstrated to the Adjudicator this is an issue people care about. The purpose of the PHC was for the Adjudicator and respective counsels to: identify ‘parties and participants’, note issues people wish to raise, and agree on future dates. By the end of the PHC, the Adjudicator granted ‘Party Status’ to the SLCO, the Township of Muskoka Lakes, Mr. Ross Earl, and the Appellant Mr. Lippa. In addition, the Adjudicator granted ‘Participant Status’ to thirteen people/groups, including the Lake Rosseau North Association, and the Lake Vernon Association.

The second OMB PHC will take place on Friday July 13, 2018 at 10 am and be held at the Municipal Office, 1 Bailey Street, Port Carling. As before, our legal counsel has advised that a strong turnout from residents and cottagers who are opposed to the proposed pit and quarry is important at the second PHC. It is important to continue to demonstrate to the Adjudicator that a large number of people are strongly against the proposed pit and quarry.

Looking further into the future, there is the possibility of a third PHC; no date has been discussed for a third PHC yet. The OMB Hearing itself will likely be scheduled for the spring of 2019. We will notify you of these dates once they are available.

The purpose of this letter is to remind you of the Ontario Municipal Board (OMB) Pre-Hearing Conference (PHC) to be held on Wednesday February 21, 2018 at 10 am. The PHC will be held at the Municipal Office, 1 Bailey Street, Port Carling.

The primary reason for the PHC is to determine whether Mr. Lippa and his consulting team are ready to proceed to a hearing (i.e. are his studies and reports completed). If so, the OMB Board Member may ask parties to settle on available dates for a hearing. If Mr. Lippa is not ready to proceed, then he will ask the Board for a second PHC, likely 3 or 4 months from now.

As our legal counsel has advised, a strong turnout from residents and cottagers who are opposed to the proposed pit and quarry is important at the PHC. It is important to demonstrate to the adjudicator(s) that a large number of people are against the proposed pit and quarry. As you are aware from my previous communications on this topic, Frank Lippa is seeking an Official Plan Amendment and Zoning By-law Amendment to allow a 54.8 hectare (135.4 acres) quarry, with an extraction area of 26.4 hectares (65.2 acres), in the vicinity of Butler Mill Road and Aspdin Road, less than 2 kilometers from Skeleton Lake.

The purpose of this letter is to give you further information about the upcoming February 21, 2018 OMB Pre-Hearing Conference ("PHC") to be held at the Municipal Office, 1 Bailey Street, Port Carling commencing at 10 a.m. The information that follows has been provided by SLCO's counsel, Donnelly Law.

The primary reason for the PHC is to determine whether Mr. Lippa and his consulting team are ready to proceed to a hearing; i.e. are all his studies and reports completed. If so, the OMB Board Member may ask parties to settle on available dates for a hearing. If Mr. Lippa is not "ready to go", then he will ask the Board for a second PHC, likely three or four months from now.

Setting a date for a hearing is greatly dependent on the duration anticipated. A hearing of a few days can be scheduled in the next few months; longer hearings are being scheduled later this year. We anticipate that approximately three weeks is needed for the Lippa hearing, which means that the first available dates for a hearing will likely be 9-12 months from now.

If a hearing date is set, the parties will then agree on dates to exchange witness lists, witness statements and reply statements, and visual exhibits. These exchanges normally occur approximately three months prior to the hearing date.

At the PHC, the SLCO and the Township of Muskoka Lakes will be seeking "party" status. A party must demonstrate that it has some interest in the proceedings (e.g. property ownership, concern for the environment) and must have communicated with Council regarding the application (e.g. attended Council's meeting and vote on June 10, 2017). If party status is granted (which is likely), SLCO will have the right to call expert evidence, cross-examine Lippa's witnesses, and make closing arguments.

Citizens who wish to have "party" status should be prepared to call expert evidence on any issue that they raise; if the citizen plans to give evidence him/herself ("lay witness"), it is preferable he/she have recognized credentials which qualify them to give evidence on that issue. Parties that call lay witness evidence only and do not assist the Board may be liable for costs. Citizens who do not have the credentials to be a witness, but who wish to participate by giving a short statement, can alternatively ask for "participant" status. SLCO will assist participants by drafting a Participant Statement which anyone who is opposed to the quarry can sign and submit.

The onus to prove the quarry represents good planning and will not adversely impact the environment rests with Mr. Lippa. It is his lawyer's responsibility to provide the issues his consultants will be addressing at the hearing. Anyone wishing to seek party or participant status should come to the PHC with a rough outline of their issues; e.g. noise, dust, water quality, traffic safety, etc. Expert witnesses will not be called at the PHC.

SLCO will be contacting Mr. Lippa's lawyer to ascertain whether a hearing date will be sought at the PHC, or whether this PHC is just a status update. I will advise you of the response we receive. In the meantime, please feel free to contact me with your questions or concerns.

With 2018 underway, I wanted to send you an update on the actions the SLCO Board and our lawyer, David Donnelly, have taken with respect to opposing the proposed Lippa pit and quarry.

We have retained a number of experts to help us prepare our case for the OMB hearing. We have already received a preliminary report from a traffic safety expert, who has identified a number of issues that would arise on Aspdin Road as a result of the heavy truck traffic that would be generated by the quarry operations.

We are also meeting this week with David Pink, Director of Planning for the Township of Muskoka Lakes. As you know, Township Council unanimously rejected Lippa's re-zoning application for the quarry, and we are working with David to co-ordinate our opposition.

A reminder that a pre-hearing conference will be held on Wednesday, February 21, 2018. The purpose of this conference is to determine the issues, parties, and participants prior to the actual Ontario Municipal Board (OMB) hearing, which is expected to take place later this year or early 2019. As David has advised, a strong turnout from residents and cottagers who are opposed to the proposed pit and quarry is important at the pre-hearing conference. Thus, please mark Wednesday, February 21, at 10:00 am at the Township of Muskoka Lakes Council Chambers in Port Carling on your calendar, and plan to attend if possible.

In the interim, we encourage all members to go to the SMP website (stopmuskokapit.ca) and sign the petition opposing the Lippa quarry. The petition represents the voice of many in the community. There are now almost 2,000 signatures on it!

As communicated last month, SLCO has sufficient funds to meet both the legal and expert costs it is currently incurring, up until the pre-hearing conference. However, substantial additional monies will be required if we are to succeed at the subsequent OMB hearing. Our intention is to launch a fundraising effort over the next few months.

A brief note to keep you informed on the status of the proposed Lippa pit and quarry:

As many of you are aware, SLCO and the “Stop Muskoka Pit” group have been working together to oppose a 200,000 tonne/year pit and quarry that Frank Lippa is proposing to develop at a site 1.7 km from Skeleton Lake. In June of this year, the Township of Muskoka Lakes Council voted unanimously to deny Mr. Lippa’s rezoning application, in response to concerns raised about the impaired water quality, noise, and traffic that would result from such an operation. Mr. Lippa subsequently filed an appeal to the Ontario Municipal Board (OMB). In response, SLCO has retained external counsel (David Donnelly) and various experts to assist us in opposing Mr. Lippa’s appeal.

Last week, we received some new information about the OMB Lippa appeal hearing. Specifically, a pre-hearing conference will be held on Wednesday, February 21. The purpose of this conference is to determine the issues, parties, and participants prior to the actual OMB hearing, which is expected to take place next summer. As David advises, a strong turnout from residents and cottagers who are opposed to the proposed quarry will be important at the pre-hearing conference. Thus, please mark Wednesday, February 21, 10:00 am at the Township of Muskoka Lakes Council Chambers in Port Carling on your calendar, and plan to attend if possible.

Fortunately, SLCO has sufficient funds on hand to meet the legal and expert costs it is incurring, up until the pre-hearing conference. However, substantial additional monies will be needed if we are to mount a successful opposition at the subsequent OMB hearing. District of Muskoka Considering Policy Change Regarding # of Waterfront Condos & Residential Communities

The District of Muskoka is considering a policy change that will result in an alarming increase in the number of condos and residential communities on the Muskoka waterfront. In an attempt to preserve Muskoka's "grand resort" tradition, the District’s planners are suggesting that commercial resorts should be allowed to redevelop as residential communities. The current proposal is that these "hybrid" resorts could designate up to 50% of their units as conventional homes. The rest would be required to enter a "rental pool" for an undetermined number of weeks per year.

The problem is that resorts in Muskoka have special dispensation to build at much higher density than residential communities. (The District calls this "enhanced density permissions.") Developers are watching to see if this change goes through. If it does, we could see new, high-density residential development all over Muskoka, on big lakes and small.

SLCO / Lippa Quarry Update - What to Expect at the OMB

SLCO is continuing preparations for the Lippa Pit/Quarry Ontario Municipal Board (OMB) hearing. Many of you probably have questions about what to expect at an OMB hearing. Here is a brief take on the hearing process from our lawyers at Donnelly Law.

Hearing Process: While each OMB hearing is unique, aggregate applications generally follow the same process leading up to the hearing.

Step 1: The Prehearing Conference. Mr. Lippa filed his appeal on July 10, 2017. The Prehearing conference should be scheduled for a one-day Board attendance within a few months of receiving Mr. Lippa's application. Prehearings deal with procedure and set out a roadmap for the hearing. At the Prehearing, the Board will determine and grant "Party" and "Participant" status.

It is important to get a good turnout to the Prehearing conference.

Step 2: The Hearing Issues. The parties to the appeal list their "issues" for the hearing. For example, does the application conform with the Township Official Plan? Are negative impacts to Skeleton Lake expected? Will the operation meet Provincial noise limits? Since Mr. Lippa appealed Council's decision, the onus is on Mr. Lippa to prove his application is good planning and complies with planning requirements.

Step 3: Witness Lists and Statements. The parties to the appeal advise each other who they will call to give evidence. OMB hearings focus mainly on expert evidence. For an aggregate application like this , we can expect to hear from a range of disciplines: land use planning, terrestrial and aquatic ecology, hydrogeology (groundwater), hydrology (surface water), water quality, traffic engineering and safety, cultural heritage, and acoustical engineering. In advance of the hearing, witnesses are required to produce a witness statement, which is a summary of their professional opinion, key conclusions and recommendations, based on their investigations and analysis.
Step 4: Hearing on the Merits. We anticipate this hearing will be 2-3 weeks in length. It is rare for the Provincial Government to intervene and participate in an OMB hearing. SLCO will be asking both the MNRF and MOECC to defend the important environmental features involved in this application, including Skeleton Lake.

Role for the Public: Many people are asking how they can get involved and support SLCO for the OMB hearing.

Attendance: OMB prehearings and hearings on the merit are open to the public. A hearing day is typically 10 am - 4 pm. We expect the hearing on the merits to be scheduled sometime in Spring 2018, at the earliest.

Frank Lippa appeals ToML decision to Ontario Municipal Board

As expected, Mr. Frank Lippa is appealing to the Ontario Municipal Board (“OMB”) the decision of the Township of Muskoka Lakes to reject his pit and quarry applications. The Township has confirmed that Mr. Lippa filed his appeals on July 10, 2017.

SLCO and residents turned out in great numbers to the Township of Muskoka Lakes Council meeting on June 16, 2017, to voice their concerns with Mr. Lippa’s Planning Act applications to permit a 200,000 tonnes/year pit and quarry – and it worked. Council voted unanimously to deny Mr. Lippa’s rezoning and Official Plan applications . Thanks to your support, SLCO put forward an evidence-based case for Council to reject the Lippa pit and quarry.

On June 26, 2017, the Town of Huntsville also voted unanimously to support the Township of Muskoka Lakes’ decision.

Below, please find information from our lawyer on what to expect with an OMB appeal, and how you can help.

SLCO expects a contested hearing, as multiple unresolved issues have been identified by our experts, e.g. impacts to Skeleton Lake, traffic safety, noise, etc. We have heard that local Indigenous communities received stacks of binders from the Applicant in late May, only a short time before the June Council meeting, which our lawyer says is "patently unreasonable".

Information on OMB Hearings

Timing of the Hearing: The OMB's hearing schedule dictates when the hearing will take place. Currently, we do not expect a hearing until 9-12 months in the future.
Length of the Hearing: OMB hearings on contested aggregate planning applications may last 2-3 weeks, depending on the disputed/unresolved issues involved (e.g. hydrogeology, water, ecology, planning, traffic engineering and safety, etc.).
Procedure before the Hearing: There will likely be a Pre-hearing Conference for the Lippa appeals in the next 4 months. At the Pre-hearing Conference, parties and participants will be granted status, and the OMB will ask the parties to work on the Procedural Order. The Procedural Order is the "road map" for the hearing, setting out dates for the parties to exchange issues list, witness lists, witness statements, etc.
Evidence at the Hearing: OMB hearings are expert-driven. This means that in order to support its case, SLCO will continue to work with the experts it retained to review the Lippa applications: land use planner, ecologist, traffic impacts and safety, noise, and others.

The OMB hearing requires a substantial financial commitment in order for SLCO to put its best case forward to convince the OMB to refuse Mr. Lippa's proposed pit and quarry.

SLCO members continue to voice the importance of protecting and enhancing the health of our Skeleton Lake watershed, and according to Mr. Gord Miller, the former Environmental Commissioner of Ontario, the Lippa pit and quarry application is a direct threat to the Lake we all love.

Ministry of Natural Resources and Forestry: Aggregate Licence Application

July 10, 2017, was the deadline for the public to submit Letters of Objection to the Ministry of Natural Resources and Forestry. SLCO submitted comprehensive and expert-based objections, thanks to your support. We also thank those of you who submitted your own Letters of Objection to the Ministry, ensuring our community's voice is heard. These will be available on our website.

We eagerly await the Applicant's response to our concerns about the impacts to Skeleton Lake and our community, and will update you once we have them.

The Ministry is responsible for processing Mr. Lippa's aggregate licence application under the Aggregate Resources Act. There is a chance that the Ministry will refer Mr. Lippa’s licence application to the OMB. Often, the OMB will hear both planning appeals (rezoning and Official Plan matters) and aggregate licensing matters in a single hearing.

Other Updates on the Lippa Pit and Quarry

To date, there have been no comments from the Province on the application on many important issues, such as impacts to Skeleton Lake tributaries and the Lake, air quality, noise, etc.

The Township of Muskoka Lakes will also be preparing its case against the Lippa pit and quarry. SLCO needs to engage the Township to ensure it continues to represent our community’s voice and hires experts to support this position.

SLCO files Letter of Objection to Lippa Application with MNRF

Yesterday, the SLCO's legal council, Donnelly Law, filed an official Letter of Objection with the MNRF calling on them to reject the application by Mr. Frank Lippa for a Class "A" License to operate a pit and quarry on Butler Mill Rd.

SLCO Signals It's Opposition to the Proposed Lippa Pit & Quarry

Today the SLCO sent a letter to the Township of Muskoka Lakes Planning Director David Pink, registering it's opposition to an application by Mr. Frank Lippa to create a large pit and quarry operation on Butler Mill Rd, just north of Skeleton Lake off of Aspdin Rd.

The SLCO feels the proposal, known as The Lippa Pit & Quarry (Lippa), could have a significant impact on the environment at the north end of the lake, the residents who access the area from Aspdin Road, and could potentially impact our water quality.

The proposed Lippa operation would require an amendment to the Official Plan as well as changes to the zoning of the lands where the quarry would be located. The proposed amendments are to be considered at a council meeting scheduled June 16th at ToML council chambers in Port Carling. WATCH YOUR BEECH TREE!

Muskoka Beech are under attack by the Beech Bark Disease, an insect-fungus complex. This disease has now pretty much spread through the entire range of the beech species. In the insect stage of the disease, the crawler nymphs, less than a millimetre, hatch in late summer, soon cover themselves in a white, woolly wax filament and feed by inserting their stylet into the inner bark of the tree.

The scale insect looks like a white tuft and the colonies can be numerous enough to lend a whitish cast to the bark. By spring the adult stage of the scale continues to feed and lays its eggs in the summer. The insects do not kill the tree but do weaken it over time.

In the fungus stage of the disease, the fungal spores are carried by wind and rain and over a period of 2-10 years, enter the feeding wounds left by the scale insect,. The fungus feeds on the inner bark and cambial layer causing small cankers to appear on the surface of the smooth bark.

These cankers continue to grow and often within 3-6 years girdle the stem. The conspicuous clusters of fruiting bodies of the sexual stage appear in the fall as red coloured bulbs some 2-3 mm in height and can be numerous enough to give a reddish cast to the bark.

For the cottager, damage can occur from dead branches or the collapse of the tree. Careful inspection of your beech treecan identify the insect and the fungal stages of the disease and precautionary measures can be taken.

FOCA Represents Cottagers in Talks With Hydro One on roll out of New "Seasonal" Rate Classes

UPDATE - June 10, 2015: Further to the Ontario Energy Boards decision (see below) to reassign customers formerly in the “seasonal” customer class, FOCA is participating in discussions with Hydro One about how to roll people into new rate classes effective January 1, 2016. The meeting held this June 10th allowed FOCA to see several proposed options of how this could be done, what rate changes to expect and how the changes could be phased in over time. The changes will affect some hydro consumers more than others, and FOCA is assessing how large consumers, typical consumers and small consumers will see their hydro bills change. Hydro One will make its final recommendation to the Ontario Energy Board August 4th. Intervenors including FOCA will be providing feedback during this process. Read more here...

The Annual General Meeting (AGM) of the Skeleton Lake Cottager's Association (SLCO) was held at Troy Cove Marina on August 9th, 2014 at 10am.

More than 50 voting members attended, and almost as many again from the general public. The President, Doug Dougherty welcomed everyone and introduced the Directors of the SLCO. He introduced the Mayor of the Township of Muskoka Lakes, Alice Murphy, who made a surprise visit. She addressed the meeting briefly and congratulated the all those involved in developing the Lake Plan document. Having perused the document, she commented on the detail in the Plan and urged the Directors to present it at a Planning and Economic Development Committee of the District Municipality of Muskoka.

The meeting proceeded with the President's Remarks, the Treasurer's Report and the Water Quality Report. The details of these and the Standing Committee Reports will be posted on the web site entitled Minutes of 2014 AGM.

Doug Dougherty presented a slide deck outlining the development and final draft of the Skeleton Lake Plan and Stewardship Program. There were several questions and then the Members were asked to vote on a motion to accept the Plan/Program, publish the document and begin implementation. The motion was approved unanimously. The President was elated, as were those involved in the project and the Members. It was the culmination of almost five years of work. Congratulations all around!

The Chair of the Nominating Committee reported that the following Directors were seeking re-election to the Board: Ken Auden, Lou-Enne Bartolomeu, Jeff Crocker, Cary Deloye, Timolin Daniel, Doug Dougherty, Jim Dyment, Sherril Johnson, Teddene Long, Al Marshall, Scott May, Paul Pieper, Kathi Poupard, Geoff Ross, Paul Smith and Sandi West.

There was a call for nominations from the floor and Bob Smith was nominated. The motion for approval of the above nominees was approved. These seventeen Directors assume the responsibility for the management of the corporation for the 2014/15 year.
